DISCIPLINE AND GRIEVANCE
When do you start a disciplinary procedure or a grievance procedure? Do you know that it is a legal requirement to have these and are you confident when and how to use them?
Legislation is in the process of being adjusted and the latest ACAS Discipline and Grievance Code of Practice are due to come into effect in April 2009. Current contracts of employment and/or Employee Handbooks may need changing in light of these changes.
You may already have documents called ‘Disciplinary Procedure’ and ‘Grievance Procedure’, but are they appropriate for your business or have you found they don’t quite fit? All HR policies should be tailored to your business. Template policies do not account for the unique way that your business operates and in many instance the use of them exacerbates problems.
· Do your supervisors and managers know how and when to use the procedures?
· Have you trained and given them the skills they need to manage effectively?
What do you do when there are accusations of discrimination or bullying and harassment?
If you use good practice advocated by HR Professionals and ACAS you will usually be able to avoid expensive legal costs and Employment Tribunal cases.
